People with substantial estates need to plan for the disposition of their assets upon death, and for the tax consequences that they will encounter. Failure to make appropriate legal preparations can be very costly, and can lead to confusion and even litigation among family members.
When there is a death, all property owned solely by the decedent must pass through a legal process called probate. The court appoints an administrator who must pay creditors and taxes, if any, and make distributions to heirs.
A trustee has a tremendous responsibility. They are responsible to the beneficiaries of the trust, and to the decedent who established the trust. They are required to administer the trust and its assets in accordance with the terms of the trust. If a trustee does not have competent legal counsel, he may find himself personally liable, even if his intentions are good.
